- INTRODUCTORY PROVISIONS

1.2 Acceptance of Terms
By accessing, browsing, or making a purchase through this online store (hereinafter “Store”), you
(“Customer” or “Buyer”) agree to be legally bound by these Terms and Conditions (hereinafter “Terms”),
as well as our Privacy Policy, Cookie Policy, and all other posted guidelines and rules. These Terms
constitute the entire agreement between you and Limestone Tube Amplifiers (“Seller”) regarding online
purchases.
If you do not agree to any of these Terms, please do not use this Store or make any purchases.
1.3 Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the
Republic of Croatia, without regard to conflict of law principles. Both parties agree to submit to the
exclusive jurisdiction of the courts of the Republic of Croatia. - DEFINITIONS
Distance Contract: A contract concluded between the Seller and Consumer through electronic means
(the Internet) without the simultaneous physical presence of the parties, as defined in the Consumer
Protection Act of the Republic of Croatia.
Consumer: Any natural person acting for purposes which are outside their trade, business, or
profession.
Digital Content: Any digital data or services provided through this Store, including product specifications,
images, and downloadable documentation.
Product Conformity: Compliance with product characteristics as described in the Store listing and
subject to legal warranty requirements under Croatian law.[2]
Withdrawal/Right of Cancellation: The Consumer’s right to unilaterally terminate a distance purchase
contract within 14 calendar days from delivery, as mandated by EU Consumer Rights Directive and
Croatian Consumer Protection Act. - CONTRACT FORMATION AND PURCHASEPROCESS
3.1 Offer and Acceptance
All product listings, descriptions, prices, and images displayed on the Store constitute an invitation to
make an offer and are not themselves binding offers. By adding products to your shopping cart and
proceeding to checkout, you make a binding offer to purchase.
The Seller accepts this offer by confirming your order via online store and processing your payment.
3.2 Order Confirmation
Upon successful payment processing, you will receive an order confirmation email containing:
Order number and date
Itemized list of products purchased
Total price including all taxes and delivery charges
Delivery address and estimated delivery date
Instructions for exercising the Right of Withdrawal
3.3 Eligibility
You must be at least 18 years of age to purchase from this Store. By making a purchase, you warrant
that you have the legal capacity to enter into a binding contract and that you will comply with all
applicable laws and regulations.

All prices are displayed in Euros (EUR) as indicated
Prices include all applicable Value Added Tax (VAT) at the current Croatian rate (currently 25% for most
products)
Additional costs (shipping, customs duties, import taxes) will be clearly stated before final purchase

4.1 Product Descriptions
All product descriptions, specifications, images, and videos are provided for informational purposes.
While we strive for accuracy, we do not warrant those descriptions are error-free, complete, or current.
Technical specifications for vacuum tube amplifiers are subject to manufacturing tolerances within
industry standards.
4.2 Product Conformity and Legal Warranty
Two-Year Legal Warranty: Pursuant to the Consumer Protection Act of the Republic of Croatia and EU
Directive 2019/771, all goods sold through this Store come with a statutory two-year legal warranty from
the date of delivery, regardless of any commercial warranty offered by the manufacturer.
During this period:
Goods must conform to the contract (match the description, quality, and fitness for purpose)
Any lack of conformity discovered within one year is presumed to have existed at the time of delivery,
unless the Seller proves otherwise
After one year, the burden of proof shifts to the Consumer to demonstrate the non-conformity existed at
delivery
4.3 Your Rights for Defective Products
If a product does not conform to the contract, you have the right to:
Request repair of the defective product at no cost
Request replacement with a conforming product
Request a price reduction proportionate to the non-conformity
Terminate the contract and receive a full refund if: The defect cannot be remedied
The defect is serious
Repair/replacement has failed or caused significant in convenience 2.3.4.
Repair or replacement must be completed within a reasonable time frame (maximum 30 days) without
significant inconvenience to you.
4.4 Commercial Warranty
The manufacturer may offer additional commercial warranties on specific products. Such warranties are
provided in addition to, not in place of, the statutory legal warranty. Details of any manufacturer warranty
will be clearly indicated on the product listing.
4.5 Exclusions from Warranty
The legal warranty does NOT cover defects arising from:
Normal wear and tear
Misuse, abuse, or improper handling by the Consumer
Failure to follow provided instructions or maintenance recommendations
Unauthorized modifications or repairs
Use beyond the product’s intended purpose
Damage caused by external factors (accidents, natural disasters, power surges) - PAYMENT TERMS
5.1 Accepted Payment Methods
We accept the following payment methods:
Credit/Debit Cards (Visa, Mastercard) via secure payment gateway
Other methods as indicated at checkout
5.2 Payment Processing
Payment is processed immediately upon order submission
Your financial institution may charge additional fees for international transfers

5.3 Failed Payments
If payment processing fails:

We will attempt to notify you of the failure

6.1 Delivery Partners

Courier services for expedited delivery (where available)
6.2 Delivery Timeframes
Estimated delivery times are:
Within Croatia and EU Member States: 5-10 business days
These are estimates only. The Seller is not liable for delays caused by courier services, customs, or
force majeure events (natural disasters, strikes, pandemics, etc.).
6.3 Shipping Costs
Shipping costs are calculated based on destination, package weight, and selected delivery method
Shipping costs are displayed and confirmed before final purchase
Free shipping may apply to orders above a specified value (as indicated at checkout)
The Consumer bears the cost of return shipping unless the return is due to the Seller’s error or a
defective product
6.4 Delivery Risk Transfer
Risk of loss or damage to goods passes to the Consumer at the moment of delivery to the courier
service or, if collected in person, at the moment of collection. You are responsible for inspecting goods
upon receipt.
6.5 Delivery Failure
If delivery cannot be completed after reasonable attempts:
The courier will attempt redelivery or hold the package for collection
You will be notified of alternative arrangements
Extended storage may result in additional fees imposed by the courier (not by the Seller)
6.6 Customs and Import Duties
For deliveries outside the EU:
You are responsible for payment of any customs duties, import taxes, or tariffs
These costs are NOT included in the displayed price
The Seller is not liable for delays or refusals of entry by customs authorities - RIGHT OF WITHDRAWAL (14-DAY COOLING-OFF PERIOD)
7.1 Right to Cancel
Pursuant to the Consumer Protection Act of the Republic of Croatia and EU Distance Selling Rules,
Consumers have the right to cancel a distance purchase contract within 14 calendar days from the date
of delivery of the goods, without giving any reason and without penalty, except for the cost of returning
the goods.
7.2 Withdrawal Conditions
The right of withdrawal applies provided that:
The Consumer has not opened or used the product (goods must be in original, unused condition)
The product packaging is intact and shows no signs of use
All original accessories, documentation, and materials are included
For custom or bespoke amplifiers: withdrawal may be limited if production has commenced.
Special Note for Tube Amplifiers: Once a vacuum tube amplifier has been powered on or tested, it is
considered “used” and withdrawal may be restricted. We recommend inspection before powering on.
7.3 How to Exercise Withdrawal Rights
To withdraw from a contract:

Include your order number, order date, and reason for withdrawal (optional)
Notice must be sent within 14 days of delivery
You may use the model withdrawal form provided in Section 7.
7.4 Return Procedures
Returning Withdrawn Goods:
Upon receipt of withdrawal notice, the Seller will provide return shipping instructions.
Consumer bears the cost of return shipping unless the return is due to the Seller’s error
Ship the goods back within 14 days of sending the withdrawal notice.
Use tracked/insured shipping; we recommend obtaining proof of return.
Reimbursement:
Full purchase price will be refunded within 14 calendar days of receiving returned goods or, at the earliest, within 14 days of confirming withdrawal notice. Refunds will be credited to the original payment method.
If payment was made by bank transfer, refund will be processed via bank transfer.
No deductions will be made except for reasonable costs of returning goods

Implied warranties of merchantability or fitness for a particular purpose
Non-infringement of intellectual property rights
Uninterrupted or error-free operation
8.2 Liability Limitations
To the fullest extent permitted by Croatian law, the Seller shall not be liable for:
Indirect, incidental, special, consequential, or punitive damages
Loss of profit, revenue, business opportunity, or data
Damage caused by third parties, including couriers or payment processors
Any damages arising from use or inability to use the Store or products
Maximum Liability: The Seller’s total liability to the Consumer shall not exceed the price of the product
purchased, except where such limitation is prohibited by mandatory Croatian consumer protection law.
8.3 Statutory Rights
Nothing in these Terms shall limit statutory rights that cannot be waived under Croatian law, including
the two-year legal warranty and the right of withdrawal. - INTELLECTUAL PROPERTY RIGHTS
9.1 Ownership
All content on this Store—including but not limited to text, images, videos, graphics, logos, schematics,
technical drawings, and design elements—is the intellectual property of Limestone Tube Amplifiers or its
content providers and is protected by copyright, trademark, and other intellectual property laws.
9.2 Limited License
You are granted a limited, non-exclusive, non-transferable license to view and print content from this
Store for personal, non-commercial use only. You may not:
Reproduce, modify, distribute, or publish any content without written permission
Use content for commercial purposes
Remove or alter copyright, trademark, or other proprietary notices
Use technical drawings or schematics to manufacture competing products
9.3 Use of Product Information
Product specifications, circuit diagrams, tube biasing data, and technical documentation provided are for
reference purposes only. You may not use this information to reverse-engineer, copy, or commercially
reproduce Limestone amplifier designs without explicit written consent.
9.4 User-Generated Content
Any reviews, comments, or feedback you provide become the property of Limestone Tube Amplifiers
and may be used for marketing, improvement, or other business purposes without compensation or
further notice. - PRIVACY AND DATA PROTECTION
10.1 Personal Data Collection
We collect personal data (name, address, email, phone) necessary for order fulfillment and
communication. This processing is lawful under the performance of contract principle under Article
6(1)(b) GDPR.

11.1 Prohibited Activities
You agree NOT to:

Engage in unlawful, fraudulent, or deceptive conduct
Harass, threaten, or defame others
Infringe on intellectual property rights
Distribute malware, viruses, or harmful code
Attempt to gain unauthorized access to the Store or payment systems
Resell products in violation of applicable resale restrictions
Circumvent security measures or reverse-engineer systems
11.2 Enforcement
The Seller reserves the right to:

12.1 Complaint Procedure
If you have a complaint regarding a product or service:

We will respond within 10 calendar days.
12.2 Dispute Resolution
Informal Resolution: We encourage resolution through direct communication. Please allow 30 days for
us to investigate and respond.
Formal Complaints: If informal resolution is unsuccessful, you may file a formal complaint with:
Croatian Chamber of Trades and Crafts (Hrvatska Gospodarska Komora)
Market Inspectorate (Tržišna inspekcija) for consumer protection violations
Consumer Ombudsman (Ombudsman) for unresolved disputes
Online Dispute Resolution: EU consumers may also use the OEJOP Platform
(https://webgate.ec.europa.eu/odr/) for online dispute resolution.
12.3 Legal Proceedings
Both parties agree to first attempt amicable settlement. If settlement fails, disputes shall be resolved in
the competent courts of the Republic of Croatia, in accordance with Croatian procedural law.
12.4 Limitation Period
Legal action must be initiated within the statute of limitations under Croatian law (generally 3 years for
consumer contracts). - FORCE MAJEURE
13.1 Definition
Neither party shall be held liable for failure to perform obligations due to events beyond reasonable
control, including but not limited to:
Natural disasters (earthquakes, floods, storms)
War, terrorism, civil unrest
Pandemics or health crises
Government actions or sanctions
Strikes or labor disputes
Utility failures or infrastructure damage
Acts of God
13.2 Notice Requirement
If a force majeure event prevents performance, the affected party must:
Notify the other party within 5 business days
Describe the event and expected duration
Describe efforts to resume performance
13.3 Suspension of Obligations
During force majeure events:
Delivery timelines are suspended (extended by the duration of the event)
Payment obligations may be deferred with agreement
Either party may terminate if force majeure prevents performance for >90 days - MODIFICATIONS TO TERMS
14.1 Right to Amend
The Seller reserves the right to modify these Terms at any time. Changes become effective:
Immediately upon posting to the Store (for non-material changes)
Upon 30 days’ written notice (for material changes affecting Consumer rights)
14.2 Continued Use
Your continued use of the Store after notification of changes constitutes acceptance of the modified
Terms. If you do not accept changes, you must stop using the Store and may exercise withdrawal rights
for pending orders.
14.3 Version Control

Previous versions are available upon request
Material amendments will be highlighted on the Store homepage - SEVERABILITY
If any provision of these Terms is found to be invalid, illegal, or unenforceable under Croatian law, such
provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if not
possible, severed. All other provisions shall remain in full force and effect. - ENTIRE AGREEMENT
These Terms and Conditions, together with the Privacy Policy and Cookie Policy, constitute the entire
agreement between you and Limestone Tube Amplifiers regarding purchases and use of the Store.

These Terms are provided in English. If translated into other languages, the English version prevails in
case of disputes.
18.2 Waiver
The Seller’s failure to enforce any provision of these Terms does not constitute waiver of that provision
or any other provision.
18.3 Assignment
You may not assign, transfer, or delegate your rights or obligations under these Terms. The Seller may
assign these Terms to a successor company or buyer of its business without notice.

4.6 Special Warranty Conditions for Vacuum Tubes
Vacuum tubes are electro-mechanical devices operating under high temperature and high voltage
conditions
and are inherently subject to gradual wear and limited operational lifespan.
For warranty purposes, vacuum tubes are classified as consumable components.
Vacuum tubes supplied with Limestone products are covered exclusively against manufacturing defects
present at delivery.
Vacuum tubes manufactured by Ray Tubes are covered by a commercial manufacturer warranty of one
(1) year in accordance with Ray Tubes warranty policy.
Normal operational aging does NOT constitute defect, including:
- emission reduction
- tonal variation
- microphonics or noise increase
- gain drift
- reduced lifespan due to operating hours
Burn-in stabilization period of up to 50 hours applies.
Warranty may be void if operated outside specified bias, ventilation, voltage parameters
or after unauthorized modification.
Tube rolling with third-party tubes is performed at user’s responsibility.
NOS tubes may be covered by Dead-On-Arrival (DOA) warranty only.
Typical expected service life (informational only): - Small signal tubes: 3,000 – 10,000 hours
- Driver tubes: 2,000 – 5,000 hours
- Power tubes (e.g., 211 class): 1,000 – 3,000 hours
